The keel of a , to have been named USS Constitution (CC-5), was laid down at Philadelphia, Pennsylvaniamarker, in September 1920. Her construction was suspended in February 1922 by the Washington Naval Treaty and she was formally canceled in August 1923, with her hull being scrapped on the building ways. Constitution was some 13.4 percent complete at the time of her cancellation. During this period the original was renamed Old Constitution to free the name for the new battle cruiser.
